Terms of Use

1. Agreement

By downloading, installing, or using The Catch Book ("the App"), you agree to be bound by these Terms of Use and End User Licence Agreement ("Agreement"). If you do not agree, do not use the App.

This Agreement is between you ("User") and The Catch Book ("we", "us", or "our").

2. Licence Grant

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on any Apple-branded device that you own or control, subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions.

3. Restrictions

You may not:

• Copy, modify, or distribute the App or any part of it
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, loan, sell, or sublicense the App
• Remove or alter any proprietary notices or labels on the App
• Use the App for any unlawful purpose or in violation of any applicable laws or regulations

4. Ownership

The App and all content, features, and functionality within it are and will remain the exclusive property of The Catch Book. The App is protected by copyright and other intellectual property laws. These Terms do not grant you any rights to trademarks or service marks of The Catch Book.

5. User Data

All catch data you create within the App — including records, trips, locations, and statistics — is stored locally on your device. Catch photos are stored securely in your personal iCloud account via Apple's CloudKit framework. We do not access, collect, or have visibility of any data you enter into the App. You are solely responsible for the data you create and for maintaining appropriate backups.

6. No Warranty

The App is provided "as is" and "as available" without warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free
• Any errors in the App will be corrected

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall The Catch Book be liable for any indirect, incidental, special, exemplary, or consequential damages (including but not limited to loss of data, loss of profits, or business interruption) arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.

Our total liability for any claims arising from this Agreement shall not exceed the amount you paid for the App (if any).

8. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies of it from your devices.

9. Updates

We may, at our discretion, release updates to the App. Updates may add, change, or remove features. Continued use of the App after an update constitutes acceptance of any revised terms that accompany that update.

10. Apple's Role

You acknowledge that this Agreement is between you and The Catch Book only, and not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide any maintenance or support for the App.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App.

Apple is a third-party beneficiary of this Agreement and, upon your acceptance of these terms, will have the right to enforce this Agreement against you as a third-party beneficiary.

11. Governing Law

This Agreement shall be governed by the laws of England and Wales, without regard to its conflict of law provisions.
